1. Service Description

FiveStarPing is an automated review request platform that helps businesses collect Google reviews from their customers via SMS. We provide tools to send review requests, filter customer sentiment, collect private feedback, and track results.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. You must provide accurate business information when creating your account.

3. Acceptable Use

By using FiveStarPing, you agree to:

• Only send review requests to customers who have consented to receive text messages from your business
• Not use the service to send spam, unsolicited messages, or messages to purchased phone number lists
• Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
• Not attempt to circumvent send limits, abuse free trials, or create multiple accounts to avoid paying
• Not use the service for any illegal or fraudulent purpose

Violation of these terms may result in immediate account suspension without refund.

4. SMS Consent & Compliance

You are solely responsible for obtaining proper consent from your customers before sending them SMS messages through FiveStarPing. FiveStarPing provides the delivery mechanism but does not verify consent. You agree to maintain records of consent and honor all opt-out requests.

5. Billing & Subscriptions

Free trial: New accounts receive a 14-day free trial with up to 10 review requests. No credit card is required for the trial.

Paid plans: After your trial, you must subscribe to a paid plan to continue sending review requests. Plans are billed monthly. Pricing is listed on our website and may change with 30 days notice.

Cancellation: You may cancel your subscription at any time through your account settings. Access continues until the end of your billing period. We do not offer refunds for partial months.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. SMS delivery depends on third-party carriers and is not guaranteed. We are not liable for messages that fail to deliver due to carrier filtering, invalid phone numbers, or recipient opt-outs.

7. Limitation of Liability

FiveStarPing is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

8. Intellectual Property

FiveStarPing and its original content, features, and functionality are owned by FiveStarPing and are protected by applicable intellectual property laws. Your customer data and review content remain yours.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, abuse of the service, or non-payment. You may delete your account at any time by contacting support.

10. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
